Terms & Conditions
Effective Date: October 2026
Welcome to TDW Creative. These Terms & Conditions outline the general principles governing the use of our website, inquiries, and creative services.
We believe successful creative partnerships are built on transparency, collaboration, and clearly defined expectations. Every business and project is different, specific terms of engagement are established individually through written proposals, statements of work, or service agreements.
1. Services & Engagement
TDW Creative provides branding, creative direction, design, strategic consultation, and related creative services.
Services may be offered through project-based engagements, ongoing creative support, or other mutually agreed arrangements.
The nature, scope, deliverables, responsibilities, and conditions of each engagement will be outlined in a separate written agreement between TDW Creative and the client.
Submitting an inquiry or participating in an initial consultation does not establish a client relationship or obligate either party to proceed.
2. Proposals, Pricing & Payment
Pricing displayed on our website is provided for general informational purposes and represents starting rates or indicative service pricing, not a guaranteed quote.
Final rates are determined based on the specific scope, complexity, resources, timeline, and requirements of each engagement.
Payment terms, including deposits, installments, billing schedules, additional fees, and payment methods, will be established in the
applicable written agreement.
TDW Creative reserves the right to revise publicly displayed pricing and service offerings without prior notice. Any changes to an existing engagement will be governed by its applicable agreement.
3. Project Timelines & Delivery
Project schedules, milestones, and delivery expectations are established individually based on the nature and requirements of each engagement.
Timelines may depend on client participation, timely feedback, required approvals, access to necessary materials, and other project-related factors.
Any material changes to scope, requirements, or circumstances may require corresponding adjustments to schedules, fees, or deliverables, subject to mutual agreement.
Specific deadlines and delivery commitments will be documented in the applicable project agreement.
4. Creative Process & Revisions
Our creative process is tailored to each engagement and may include discovery, research, strategy, concept development, design, presentation, feedback, refinement, and delivery.
The number of concepts, revision rounds, approval stages, and final deliverables will be defined in the applicable agreement.
Requests that extend beyond the agreed scope may require additional fees, revised timelines, or a separate agreement.
TDW Creative values collaborative feedback and clear communication throughout the creative process.
5. Client Responsibilities
Clients are responsible for providing accurate information, necessary materials, timely feedback, and required approvals to support the successful completion of their projects.
Clients are also responsible for ensuring they have the appropriate rights and permissions to use any materials, content, trademarks, or other assets they provide to TDW Creative.
Additional responsibilities, review periods, and approval procedures may be outlined in the applicable agreement.
6. Cancellations, Refunds & Termination
Cancellation, rescheduling, refund eligibility, and termination provisions are determined by the terms of each individual engagement.
Because creative services often involve dedicated resources, planning, research, and work performed before final delivery, fees for completed work, services already performed, or committed resources may be nonrefundable, as specified in the applicable agreement and subject to applicable law.
Any applicable deposits, cancellation charges, outstanding balances, and rights to work completed upon termination will be addressed in the relevant written agreement.
No particular refund or cancellation outcome is guaranteed unless expressly stated in the applicable agreement or required by law.
7. Ongoing Partnerships & Retainers
Ongoing creative partnerships may include recurring services, strategic consultation, creative direction, and production support.
The services included, available capacity, engagement duration, billing frequency, renewal provisions, and termination requirements will be defined in a separate written agreement.
Unless expressly agreed in writing, ongoing engagements do not imply unlimited services, unlimited revisions, or guaranteed availability.
8. Intellectual Property & Usage Rights
Ownership, licensing, usage rights, and transfer of final creative deliverables will be determined by the applicable written agreement.
Unless otherwise agreed in writing, TDW Creative retains ownership of its pre-existing materials, proprietary processes, tools, templates, and other intellectual property.
Rights to third-party materials, including licensed imagery, fonts, software, and other assets, remain subject to their respective licenses.
Any transfer of ownership or grant of usage rights will be governed by the applicable agreement and any stated payment conditions.
9. Confidentiality & Portfolio Use
TDW Creative respects the confidentiality of information shared during client engagements.
Specific confidentiality obligations, nondisclosure requirements, and permissions relating to public display of completed work will be addressed in the applicable written agreement.
TDW Creative may request permission to feature selected projects in its portfolio, marketing materials, or professional communications, subject to agreed confidentiality and usage restrictions.

TDW Creative does not control the independent policies, operations, or availability of third-party providers.
11. Results & Professional Expectations
TDW Creative is committed to delivering thoughtful, professional creative solutions aligned with the agreed project objectives.
